“If Moderna ultimately prevails in this case, there will be no further payments. Even if, however, the Federal Circuit affirms liability under Section 1498, Moderna has agreed to pay an additional $1.3 billion within 90 days of that decision, depending on the scope of the decision.”

“After that, if Moderna ultimately prevails through other proceedings — whether in remand, in the Supreme Court, or on remand to a district court — Arbutus/Genevant will refund the full payment plus interest.”

Moderna Inc. (NASDAQ: MRNA ) said it expects to record $950 million in settlement charges in the first quarter of the year and end the year with $4.5 billion to $5 billion in cash and cash equivalents.
